Proving Negligence in a Maryland Drunk Driving Civil Case

To prevail on a civil negligence claim, a plaintiff must establish four elements: the defendant owed a duty of care, the defendant breached that duty, the breach caused the accident, and the accident resulted in actual injuries and losses. Proving negligence in civil court doesn’t require establishing a specific blood alcohol concentration (BAC). A driver below the 0.08% legal threshold can still be held civilly liable if their impairment contributed to the crash. That said, a driver at or above 0.08% BAC is presumed to be under the influence under Maryland law, which is strong support for the liability element of a civil claim. A DUI arrest or charge is admissible in civil proceedings and can help establish breach of duty.
